Terms of Use — Can My Pet Eat for iPhone

These terms cover the Can My Pet Eat iPhone app. By installing or using the app you agree to them. The website terms of service are a separate document and cover canmypeteat.org.

1. This is not veterinary advice

This is the most important term on the page, so it comes first.

Can My Pet Eat is an educational reference tool. It is not a veterinarian and does not provide veterinary, medical, or diagnostic services. It cannot examine your animal. It does not know their age, weight, breed, medical history, medications, or what else they have eaten today — all of which change the answer.

It can be wrong.

Never delay contacting a veterinarian because of something this app told you. If your pet has eaten something you are worried about, call a vet or an animal poison line now. Acting early matters more than knowing exactly what happened.

Both may charge a consultation fee.

2. How the answers are produced

Answers come from two places, and the app tells you which:

  • Built-in answers are compiled into the app and were reviewed by a person before release. They are informed by sources including the ASPCA, the AVMA, the Merck Veterinary Manual, and university veterinary extension programmes.
  • Generated answers, for foods not yet in the built-in table, are drafted automatically by our server and have not been reviewed by a person. The app labels these with an “unverified” banner. Treat them with more caution, not less.

Neither kind is a substitute for professional judgement about your specific animal.

3. Licence

You are granted a personal, non-exclusive, non-transferable, revocable licence to use the app on devices you own or control, for personal, non-commercial purposes.

You may not: resell or sublicense the app; copy or redistribute its bundled food safety data as a dataset; reverse-engineer it except where that right cannot be excluded by law; or use automated means to extract data from our API at scale.

4. The service behind the app

Most of the app works with no connection at all. For foods not built in, it calls our server, which is provided on a best-effort basis.

There is a daily cap on new lookups. Once it is reached, or if the service is unavailable, the app falls back to its built-in answers and tells you so. We do not guarantee that the server will be available, that any particular food will be covered, or that the service will continue to be offered free of charge.

We may change, suspend, or discontinue the server at any time. The built-in answers will keep working regardless, because they live on your device.

5. No warranty

The app is provided “as is” and “as available”, without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.

We do not warrant that the content is accurate, complete, current, or suitable for your animal.

6. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss arising from your use of, or reliance on, the app — including harm to an animal.

Where liability cannot be excluded, it is limited to the amount you paid for the app, which is zero.

Nothing in these terms excludes liability that cannot lawfully be excluded.

7. Privacy

The app has no account and collects no personal information. See the app privacy policy for the detail of what is stored on your device and the single request that ever leaves it.

8. Apple

Apple is not a party to these terms and has no obligation to provide support for the app. Apple is not responsible for the app or its content, and is not liable for any claim relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

You confirm that you are not located in a country subject to a US Government embargo or designated as terrorist-supporting, and that you are not on any US Government list of prohibited or restricted parties.

9. Changes

We may update these terms. Material changes will be reflected on this page with a new date at the top. Continuing to use the app after a change means you accept the revised terms.

10. Governing law

These terms are governed by the laws of Spain, without regard to conflict of law provisions. If you are a consumer, this does not deprive you of the protection of mandatory provisions of the law of your country of residence.
